Notice is given of the Ordinary Council Meeting, to be held in the Council Chambers on Monday 6th December 2010 commencing at 7pm. The business to be transacted at the meeting is included in this business paper.

Council Meeting Procedures


The Council meeting is chaired by the Mayor, Councillor Win Gaffney. Councillors are entitled to one vote on a matter. If votes are equal, the Chairperson has a second or casting vote. When a majority of Councillors vote in favour of a Motion it becomes a decision of the Council. Minutes of Council and Committee meetings are published on Councilís website www.lanecove.nsw.gov.au by 5pm of the Thursday following the meeting.


The Meeting is conducted in accordance with Council's Code of Meeting Practice. The order of business is listed in the Agenda on the next page. That order will be followed unless Council resolves to modify the order at the meeting. This may occur for example where the members of the public in attendance are interested in specific items of the agenda.


Members of the public may address the Council Meeting on any issue for a maximum of 3 minutes during the public forum which is held at the beginning of the meeting. All persons addressing the Meeting must speak to the Chair. Speakers and Councillors will not enter into general debate or ask questions.

Councillors viewed the site and heard from the applicant and an affected neighbour.† Councillors also noted that the high side of the street was subject of garages at boundary as well as more recent garages displaying the standard 1m setback and splay.

Two Section 96 applications to modify an existing approval.

Councillors heard from the owners of 43 and 43A Berry Road and the owner and her adviser of 45 Berry Road.† The owner of 45 Berry Road raised issues largely relevant to the processing of the original development application (09/292).† Councillors asked that details of the original application be supplied to Councillors and the owner of 45 Berry Road.

The Section 96 application appeared marginal in nature and Councillors noted the comments of the owner of 45 Berry Road.


Environmental Services Division Report No. 473


Councillors met at the Greenwich Road frontage and heard from a range of adjoining and nearby residents.† Councillors also inspected the site from the vantage point of a number of adjoining sites in both Greenwich Road and Anglo Road.

Councillors noted the concerns of affected owners and residents and particularly the parking and building setback standards of the State Governmentís Affordable Housing SEPP compared with that of Councilís DCP.

Councillors and residents also heard from the town planner representing the applicant who advised that a number of amendments have been made to the original proposal which are designed to provide greater internal amenity from both residents of the site and adjoining land owners.† Councillors also noted that the application, as proposed, fully complies with the provisions of the affordable housing SEPP.




A number of Councillors inspected the bushland track at the rear of Borambil Place properties and noted the boggy conditions.







That the Minutes of the Inspection Committee of 4 December 2010 be received and noted.
