Notice of Motion - Creating a safe segregated cycleway for Lane Cove Cyclists to North Sydney and Sydney CBD

Background

 

Council at its Ordinary Meeting on 20 November 2017, considered a Notice of Motion presented by Councillor Zbik, in regards to creating a safe segregated cycleway for Lane Cove Cyclists from Naremburn to North Sydney and the Sydney CBD and resolved to:-

 

1.   Write to the relevant Departments of the NSW State Government (Roads and Maritime Services, Department of Planning and Environment) to commit to funding and a timeline for construction of a segregated cycle way from Naremburn to the Sydney Harbour Bridge; and

2.   Write to neighbouring North Sydney, City of Ryde and Willoughby Councils requesting that all four Councils work together to campaign the NSW State Government for the completion of the segregated cycle way from Naremburn to the Sydney Harbour Bridge.

 

Since that meeting, the Roads and Maritime Services has called for feedback on the proposal to improve accessibility to the Sydney Harbour Bridge cycleway at both the northern and southern ends by:-

 

·    Providing step-free access for cyclists at the northern end of the cycleway by constructing an elevated ramp at Milsons Point; and

·    Providing a dedicated connection for cyclists from the Sydney Harbour Bridge cycleway to the Kent Street cycleway, and an improved cyclist and pedestrian bridge over the Cahill Expressway with new approach ramps.

 

Both of these proposals will help to make cycling easier and safer for residents of Lane Cove who opt to cycle to the Sydney CBD.

RECOMMENDATION

 

That Council:-

 

1.   Reconvene the recently disbanded Bicycle Advisory Committee to seek their input for the Sydney Harbour Bridge cycleway access proposal by the Roads and Maritime Service; and

 

2.   Make a submission to the Roads and Maritime Service supporting the proposed improvements.

Delegation of Authority During the Christmas Recess

Executive Summary

 

In past years it has been Council’s practice to delegate authority to a Committee comprising of the Mayor and the General Manager to deal with urgent matters arising during the Christmas recess.  In such cases, Council’s policies are applied and if no such policies exist, due caution is exercised.

 

Discussion

Over the Christmas period the notification period for new Development Applications is extended until February to ensure that notifications are effective even with the vast majority of the community on holidays. It is the normal practice to grant authority to the Mayor and General Manager to determine any matters which may arise during the Christmas recess, which is consistent with s226 of the Local Government Act, “to exercise, in cases of necessity, the policy-making functions of the governing body of the council between meetings of the council.”

 

 

RECOMMENDATION

That:-

1.   Subject to the provisions of Section 377 of the Local Government Act, 1993, and point 2 below, Council appoint a Committee comprising of the Mayor and the General Manager, or in their absence a delegate of the Mayor and/or the person acting as General Manager, to deal with and determine, urgent matters arising during the Council recess until 19 February 2018, in such cases applying Council’s policies, or where no such policies exist, exercising due caution.

2.   No Section 96 or Section 82A reviews of development applications be undertaken under delegated authority in relation to any matter that has been determined by the Independent Hearing and Assessment Panel.
