The last Council was considering the establishment of a Lane Cove Charity the purpose of which was to allow business and residents to make tax deductible contributions to the charity and Council make donations to qualifying local not-for-profits. I believe the best way to structure this charity of it is to proceed is to have a separate legal entity that would consist of a board and obtain Deductible Gift Recipient (DGR) status in its own right. To achieve this Council would require Ministerial approval.
That:- 1. The General Manager in consultation with Councillor Bennison prepare a brief for Council to consider as part of request to the Minister to operate this charity through a separate legal entity. 2. The General Manager in consultation with Councillor Bennison prepare and lodge a request for a private ruling with the Australian Tax Office to confirm Lane Cove Council’s eligibility of Deductible Gift Recipient status and that Council is able to make donations to local not-for profits. |

Subject: Building Fund

The last Council was considering the establishment of a Building Fund that would allow rate payers the opportunity to have part of their rates tax deductible where they elected to have part of their rates allocates to an approved building fund.
That:- 1. The General Manager identify possible projects from the capital works program that would qualify under the Deductible Gift Recipient rules; 2. The General Manager in consultation with Councillor Bennison prepare a brief for Council to consider on how this program would work; and 3. The General Manager in consultation with Councillor Bennison prepare and lodge a request for a private ruling with the Australian Tax Office to confirm Council’s eligibility to establish a building fund and confirm that on what conditions rate payers would be eligible for a tax deduction.

Subject: Industry Based Superannuation Schemes

On the 15 December 2011 Council wrote to the Hon. Joe Hockey MP to request changes to the SIS Act and Corp Laws relate to concerns over the management of the Local Government Superannuation Funds (attached as AT-1).
Since that date we met with Mr Hockey and I have spoken to Mr Paul Fletcher MP for Bradfield regarding our concerns.
Now that Mr Hockey and Mr Fletcher are in Government Federally, I would like Council to send a follow up letter to Mr Hockey and Mr Fletcher outlining our concerns and to consider our suggested amendment to the SIS act and Corps law.
That :- 1. A letter of congratulations be sent to Mr Hockey and Mr Fletcher on their election success; and 2. Council send a copy of our letter dated 15 December 2011 to Mr Hockey MP and Mr Fletcher MP for their consideration.

Mr Tony Abbott (MP) pledged that if he won the election that he would establish a new indigenous advisory board to headed up by Mr Warren Mundine. Now that Mr Abbott is Australia‘s new Prime Minister, Mr Ricky Lyons, Chair of Council’s Aboriginal Advisory Committee has requested that Council write to Mr Abbott and/or Mr Mundine and request a meeting to discuss some of the projects that our Aboriginal Advisory Committee are considering and what possible funding may be available.
That a letter of congratulations be sent to Mr Abbott (MP) on his election as Prime Minister of Australia and Council request a meeting with him and/or Mr Warren Mundine, with Council’s Aboriginal Advisory Committee.
