Notice of Meeting
Notice is given of the Extraordinary Meeting of Council, to be held Council Chambers on Wednesday 10 February 2010 commencing at 6:45pm. The business to be transacted at the meeting is included in this business paper.
The Council meeting is chaired by the Mayor, Councillor Win Gaffney. Councillors are entitled to one vote on a matter. If votes are equal, the Chairperson has a second or casting vote. When a majority of Councillors vote in favour of a Motion it becomes a decision of the Council. Minutes of Council and Committee meetings are published on Councilís website www.lanecove.nsw.gov.au by 5pm of the Thursday following the meeting.
The Meeting is conducted in accordance with Council's Code of Meeting Practice. The order of business is listed in the Agenda on the next page. That order will be followed unless Council resolves to modify the order at the meeting. This may occur for example where the members of the public in attendance are interested in specific items of the agenda.
Members of the public may address the Council Meeting on any issue for a maximum of 3 minutes during the public forum which is held at the beginning of the meeting. All persons addressing the Meeting must speak to the Chair. Speakers and Councillors will not enter into general debate or ask questions.

SUBJECT: SSROC Tender for Supply of Electricity to Large Sites, Street Lighting & Green Power
It is recommended
that the Council close so much of the meeting to the public as provided for
under Section 10A(2) (d) of the Local Government Act, 1993, on the grounds that
the report contains commercial information of a confidential nature that would,
if disclosed (i) prejudice the commercial position of the person who supplied
it; or (ii) confer a commercial advantage on a competitor of the council; or
(iii) reveal a trade secret; it further being considered that discussion of the
matter in open meeting would be, on balance, contrary to public interest by
reason of the foregoing and and Tender details, should they be revealed, may
result in commercial disadvantage to parties involved in the tender process.
Some information provided to council by tenderers is provided on the basis that council will treat it as commercial in confidence.† It is not in the public interest to reveal all details of these tenders or the assessment process. Tenderers have provided sensitive information about their operations in the confidence that their details will not be made public by council. The practice of publication of sensitive information provided by tenderers could result in the withholding of such information by tenderers and reduction in the provision of information relevant to councilís decision.†

The current agreement for the provision of the supply of electricity for large sites, street lighting and green power will conclude on 30 June 2010.† Therefore Council called for tenders in accordance with Part 7 of the Local Government (General) Regulation 2005 (NSW) for the provision of supply of electricity for large sites, street lighting and green power in partnership with SSROC. A full report on the evaluation of the tender is included in the Confidential Section of this Business Paper. This Report provides details on the tender process conducted for the information of the public.
This report sets out the approach and results of a tender undertaken by the Southern Sydney Regional Organisation of Councils (SSROC), on behalf of 17 participating member councils, for the supply of electricity for large sites, street lighting and green power.
Tenders must be lodged by interested suppliers by Friday, 5 February 2010 and SSROC need to be able to accept the tender from the recommended tenderer on the following Friday,12 February 2010.
This short timeframe is due to the way the electricity industry works, including the way the market price moves on a daily basis and the hedging that these companies undertake. Delay of acceptance of such a tender could cost the 17 Councils involved a possible extra $800,000 pa, part of which would be shared by Lane Cove.
Scope of Work
Council requires the provision of the supply of electricity for large sites, street lighting and green power.†
The contract period for this service will be from 30 June 2010 for 3 years.
The tender was advertised by SSROC on behalf of 17 Councils.†
Tenders closed at 11am on Friday, 5 February 2010.† Details of the tenderers will be provided in a late addendum.
Each tender will be assessed based on the schedule of pricing; quality and value added assessment criteria and; Statement of Conformance provided by the tenderers.
The recommended tenderer will be based on the assessment information provided in the late addendum.
