Discussion
Councillors, you will recall at the last meeting our discussions and deliberations regarding the continuation of the legal defence in relation to the proposed development at 24E Upper Cliff Road in the Land & Environment Court.
I have previously stated my concerns about the potential costs of this matter and believe that as a Council we should do whatever is possible to avoid what I believe to be unnecessary legal costs. In this regard, I am not asking Council to change its previous decision at this stage, but rather I ask Council to consider requesting the lawyers for both parties to meet to determine a course of action which is acceptable to both parties and avoids further legal action. This can be achieved in the coming days and further considered by Council at its meeting of 17 December 2007 prior to the Christmas recess period.
That Council’s legal representative meet with the lawyers of the owner of 24E Upper Cliff Road to discuss a possible outcome which avoids further legal action and a further report be submitted to the Council Meeting on 17 December 2007.
